Sofia Vergara’s Battle Over Frozen Embryos

It’s a very personal decision to freeze embryos and it’s usually something that is borne of necessity. Whether a woman (or man!) is about to undergo treatment for cancer or wants to preserve her eggs as she gets older, there are very good reasons why couples decide to bank some of their embryos. What happens, then, if they break up? Should the embryos be destroyed? Can either person choose to use them to welcome parenthood? These questions, and more, are at the center of the debate between Modern Family actress, Sofia Vergara, and her ex-fiancé, Nick Loeb.

“Already Created”

He maintains that his motives are purely based on his desire to protect two lives that “have already been created.” She is calling him an opportunist and has criticized him for bringing the private matter to the attention of the public. Both have been making the rounds on morning talk shows (Vergara on Good Morning America and Loeb on Today).

Vergara, 42, explained: “I’ve been working very hard for 20 years to get to this point where I am. I promote all my movies, all my work, but I don’t like promoting my private life. And I don’t want to allow this person to take more advantage of my career and try to promote himself and get press for this.”

She seemed surprised that 39-year-old Loeb had garnered any attention for this story which has included an op-ed in the New York Times. “Why is the press allowing somebody to invent things and create press for himself?” she asked. “He’s not an actor. He’s not a celebrity. It’s like, why?”

Signed Agreement

When they created the embryos in 2013, they signed an agreement stating that both parties would need to consent in order for the embryos to be brought to full term. In light of the current debates about abortion and whether life begins at conception, it shouldn’t be a shock that the public is interested in this somewhat related topic.

Still, Vergara is rightfully upset about having to discuss something so private on the public stage. During her sit down with GMA she added: “This shouldn’t be out there for people to give their opinion when there’s nothing to talk about. There’s papers signed … I don’t understand why the media is allowing a person to just try to put me down, and make it like something is happening when nothing is happening.”

Willing to Waive Financial Obligations

Loeb, on the other hand, wants to raise the kids as a single father and believes that the actress is “going to change her mind.” On the Today show he explained: “It has nothing to do with whether it’s her baby or a baby… Lives were already created… I wouldn’t toss them aside.”

He denies any desire to be opportunistic and has offered to waive Vergara’s financial responsibilities. Instead, he claims to desperately want his children to be born and “have the best lives possible.” Meanwhile, Vergara has moved on and says that she is in a happy, committed relationship with True Blood actor, Joe Manganiello.

Weigh In

Which side of this issue are you on? Should it not even be debated in light of the signed agreement? Is Loeb entitled to become a father to his “already created” children?
